PRESIDENT'S MESSAGE

Nothing hits closer to home than a dispute between a Home Owner and the Board of Directors (who govern the Association).

Problems may develop over an architectural issue, a monetary fine, unpaid assessments or a continuing alleged nuisance. Discord might result from a failure to communicate. HOA Mediation Services, Inc. intercedes, by employing its third party, neutral mediator in a controlled settlement conference setting. Our mediators are attorneys, with a strong background in Home Owner Association law. Even though we do not provide legal advice to either side, the mediator's knowledge effectively directs the negotiation process along productive lines.

An impartial Mediator can effectively and economically resolve disputes between a Homeowner and a Home Owner Association's Board of Directors to avoid expensive lawsuits and protracted legal wrangling.

HOA Mediation Services, Inc. is a California corporation that provides mediation services to Home Owner Associations (H.O.A.s) and property Owners, in an effort to resolve disputes before litigation becomes necessary.  Mediation involves a voluntary, non-binding settlement conference before an impartial third party, the Mediator. The Mediator's goal is to:

  • Facilitate communication between the parties
  • Provide insight about pertinent issues
  • Suggest settlement options

The Mediator does not "judge" who is right nor does the Mediator "decide" who prevails. Instead, the Mediator hopes to structure a Settlement Agreement that both sides mutually accept.

Our Mediators are all experienced attorneys, who are knowledgeable about:

  • Common Interest Developments (C.I.D.s)
  • Declarations of Covenants, Conditions and Restrictions (C.C.& R.s) and other governing documents
  • The Davis-Stirling Common Interest Development Act (Civil Code sections 1350 - 1378)

Communications made during mediation are confidential and may not later be admitted as evidence at trial, should dispute resolution prove to be unsuccessful. Please see the California Supreme Court decision of Foxgate Homeowners Association v. Bramalea California, Inc. (2001) 26 Cal. 4th 1 in this regard.  The mediation process usually involves a face-to-face meeting by the Board of Directors or its Designee (representing the Home Owner Association) and the individual home Owner, along with their legal counsel, if any, held before the Mediator. After an initial joint conference session in which positions are exchanged, the parties are usually separated so that the Mediator may employ shuttle diplomacy to smooth out the process of negotiation. Parties dealing directly with one another may be so concerned with posturing amid unbridled expressions of emotion, that prospects for settlement evaporate.

HOA Mediation Services, Inc. handles both Internal Dispute Resolution (I.D.R.) and Alternative Dispute Resolution (A.D.R.) matters.  The mediation may be held at our facilities in downtown Long Beach, on site at the Home Owner Association or at any other convenient location. We schedule these conferences at 10:00 a.m., 2:00 p.m., and 6:30 p.m. Monday through Friday and at 10:00 a.m. on Saturday.

Our fees are generally split between the parties, although one side may satisfy the entire expense, either voluntarily or pursuant to the I.D.R. process.  HOA Mediation Services, Inc. provides a fair, reasonable and expeditious plan to streamline the dispute resolution process through our third party mediation techniques. WHY MEDIATION?

Board members and unit Owners may wonder why they should submit a Home Owner Association dispute to either Alternative Dispute Resolution (A.D.R.) or Internal Dispute Resolution (I.D.R.). A mediation before an unbiased third party before litigation is generally a good idea, because:

  • the law may require that you do so in order to recover attorney fees should you then be forced to file a lawsuit
  • a face-to-face settlement conference allows both sides to clearly understand the pros and cons of the disagreement
  • airing out a party's position before a Mediator can give you, as well as your adversary, a reality check
  • mediation does work to achieve an enforceable settlement in many instances without running up court costs and attorney fees
  • mediation proceedings will, in all likelihood, be scheduled within three months to expeditiously resolve a problem that could take years in litigation.
